29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  (a) Robinson Tait Construction on or about November 28, 2017 at the address of 7064 Oaktree Drive North, Lorain, OH, 44052: The employer did not have a plan or program to identify job site hazards which assists employees in maintaining a safe working environment.  Such programs would support the employer and employees in identifying and avoiding potential hazards, such as falls during job site operations, decreasing the probability of employee injury and/or illness.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a) Robinson Tait Construction on or about November 28, 2017 at the address of 7064 Oaktree Drive North, Lorain, OH, 44053: The employer had not trained employees in the appropriate use of fall protection, such as but not limited to, the use of personal fall arrest systems while performing various roofing operations.

29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system or personal fall arrest systems:   a) Robinson Tait Construction on or about November 28, 2017 at the address of 7064 Oaktree Drive, Lorain, OH, 44052: The employer did not ensure employees were protected from falls while installing new roofing materials (asphalt shingles) to a residential type structure.  The employees were exposed to a potential 20 foot fall to the level below.
