OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard from flying polyvinyl chloride (PVC) pipe fragments:   (a) Polymics, LTD, 2215 High Tech Road, State College, PA 16803 - The employer used schedule 80 polyvinyl chloride (PVC) piping of varying diameters to transport compressed air to pneumatically powered equipment and machinery, exposing employees to a struck-by hazard from flying PVC pipe fragments associated with such use of PVC piping in above ground installations. According to the Plastic Pipe Institute and the Plastic Pipe and Fittings Association, PVC piping does not possess shatter resistant properties, and failure of the piping presents a serious hazard to employees from resultant flying shards or pipe fragments which become rapidly propelled by the released energy of a suddenly decompressing gas, ASME B31.3, A323.4.2 states PVC and CPVC shall not be used in compressed air or other compressed gas service, or ASME B31.9 paragraph 923.3.2 states PVC, CPVC and PVDF, which exhibit brittle failures as determined by ASTM F412, shall not be used for compressed air or gas service, on or about November 14th, 2017.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1910.147(c)(4)(i): Procedures were not developed to ensure that lockout devices  were under the exclusive control of the authorized employee performing the servicing or maintenance:  a) Lock-out/Tag-out Program - Employees performing lock-out/tag-out procedures were exposed to possible stored energy from the availability of extra keys and alternate keys in the Maintenance toolbox, on or about November 14th, 2017.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
