29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a) On or about November 29, 2017; Second floor area of new residential construction; employees were not wearing fall protection exposing them a 30- 35 foot fall to ground level while working off the top-plate to install the rafters on the residential home.     b) On or about November 29, 2017; throughout the site; employees were exposed to falls greater than 6-feet near wall openings that were not guarded by railing.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.    a) On or about November 29, 2017; first floor of construction site; employees were accessing the second floor area by using a make shift ladder that did extend three above the platform exposing them to a10 foot fall hazard to the lower level.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).
