29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use: a- 59 Allen Lane, Lawrenceville NJ: On or about 10/06/17 a company worker was exposed to fall hazards, in excess of 21 feet to the ground surface below, when working in/from a wooden box that rested on the elevated forks of a Terex Model # TH842C Turbo All terrain fork truck. This piece of equipment was not specifically designed by the manufacturer to support a scaffold platform. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: a- 59 Allen Lane, Lawrenceville NJ: On or about 10/06/17 a company worker was exposed to fall hazards, in excess of 21 feet to the ground surface below, when working in/from a wooden box that rested on the elevated forks of a Terex Model # TH842C Turbo All terrain fork truck. This employee was not utilizing any fall protection at the time of the exposure. 29 CFR 1926.602(c)(1)(vi): Section 603E Industrial truck(s) American National Standards Institute, B56.1-1969, Safety Standards for Powered Industrial Trucks, as adopted by 29 CFR 1926.602(c)(1)(vi): When a truck was left unattended, load engaging means were not fully lowered, controls were not neutralized, power was not shut off, brakes were not set, and the key or connector plug was not removed: a- 59 Allen Lane, Lawrenceville NJ: On or about 10/06/17 workers were working from/in a wooden box (containing HVAC duct work and other related materials) that was lifted to the third floor of the worksite's commercial building from the forks of a Terex Model # TH842C Turbo All terrain fork truck. During the above mentioned activity, the fork truck was left unattended. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
