29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill:    a) On or about 12/06/2017 - Building #29 and #30 at 150 Summit Place, Birmingham, Alabama, 35243, employees who were previously trained in the use of fall protection did not recognize and avoid fall hazards of approximately 28 feet while removing and installing shingles.

29 CFR 1926.501(b)(13): The employer fails to ensure that employee(s) who engage in residential construction activities that are 6 feet (1.8 m) or more above lower levels are protected by guardrail systems, safety net systems, or personal fall arrest systems; or are the employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a) Jose Ausencio Serrato Alvarez dba Home Live Roofing, LLC fails to ensure that employees are protected from fall hazards as they remove and install shingles on roofs  that are more than 6 feet (1.8 m) or more above lower levels.  This practice of not ensuring fall protection was most recently observed on or about 12/06/2017 at the worksite located at Buildings #29 and #30, 150 Summit Place in Birmingham, Alabama, and led to employees who were engaged in residential construction activities not being protected from fall hazards of up to 28  feet.  To abate this violation, the employer must ensure that its employees are protected from falls by providing a guardrail system, safety net system, personal fall arrest system or some alternate fall provision as provided in paragraph 1926.501(b).     Jose Ausencio Serrato Alvarez dba Home Live Roofing, LLC, was previously cited for a willful violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1172732 citation number 2, item number 1, and was affirmed as a final order on January 17, 2017, with respect to a workplace located at 2104 Jefferson on the Creek, Warminster, PA 18974.      Jose Ausencio Serrato Alvarez dba Home Live Roofing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b) (1), which was contained in OSHA inspection number 1151166, citation number 1, item number 1 and was affirmed as a final order on August 12, 2016, with respect to a workplace located at 10840 State Bridge Road, Building #6, Johns Creek, GA 30022.    Additionally, Jose Ausencio Serrato Alvarez dba Home Live Roofing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b) (1), which was contained in OSHA inspection number 1080755, citation number 1, item number 1 and was affirmed as a final order on August 21, 2015, with respect to a workplace located at 4768 Oak Street, Kansas City, MO 64112.    Further, Jose Ausencio Serrato Alvarez dba Home Live Roofing, LLC was also cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b) (13), which was contained in OSHA inspection number 995980 citation number 2, item number 2 and was affirmed as a final order on November 14, 2014, with respect to a workplace located at 740 Sidney Marcus Boulevard, Bldg. #2, Atlanta, GA 30324.    Subsequently, Jose Ausencio Serrato Alvarez dba Home Live Roofing, LLC, was also cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b) (1), which was contained in OSHA inspection number 993365 citation number 2, item number 1, and was affirmed as a final order on October 3, 2014, with respect to a workplace located at 3510 Henderson Mill Road, Chamblee, GA 30341.     Finally, Jose Ausencio Serrato Alvarez dba Home Live Roofing, LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b) (13), which was contained in OSHA inspection number 945480 citation number 1, item number 3, and was affirmed as a final order on December 30, 2013, with respect to a workplace located at 945 Crestmark Blvd., Bldg. # 400, Little Springs, GA 30122.
