29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: (a) On or about , January 30, 2018, at the above addressed jobsite in the laminated room, the employer did not establish an effective hearing conservation program for employees, who operate the laminating machine, exposed to continuous noise at 67.07% of the action level noise exposure or the equivalent sound level of approximately 87.1 decibels during 356 minute sampling period; exposure calculations include a zero (0) increment for the 124 minutes not sampled.

29 CFR 1910.134(k)(1)(vii): The employer did not ensure that each user could demonstrate knowledge of the general requirements of the standard: On or about September 8, 2016, at the above addressed jobsite, the employer did not ensure that employees who are required to wear respirators during stone fabrication operations, were able to properly inspect respirators, check the seals of the respirator, know why proper fit is necessary, and how improper maintenance could compromise the protective effect of the respirator.
