Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized crushed-by hazards that were causing or likely to cause death or serious physical harm to his employees:    (a) This violation occurred on December 21, 2017 in the warehouse located at 9743 Brockbank Drive, Dallas, Texas; where employees loading/unloading materials on storage racks were exposed to a crushed-by hazard in that:    1. Employees were not aware of the maximum permissible unit load and/or maximum uniformly distributed load per level;    2. The Horizontal beams and vertical pillars were damaged.

Except as provided elsewhere in this section or by other subparts of this part, the employer did not ensure each employee on a walking-working surface 4 feet (1.2m) or more above a lower level was protected from falling by: (i) Guardrail systems; (ii) Safety net systems; or (iii) Personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems:      (a) This violation occurred on December 14, 2017 in the aisle in between racks B9 and C9 within the warehouse where an employee operating a Hyster order picker was not wearing personal fall protection and was exposed to a fall hazard of approximately 6 feet to the concrete floor below.
