OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards in the Warehouse Area:     a) Warehouse Area- Dry: On or about November 1, 2017, and at times prior, the employer exposed employees to struck-by hazards while working around commercial steel storage racks with bent and/or damaged horizontal, vertical and diagonal struts.    b) Warehouse Area-Cooler : On or about November 1, 2017, and at times prior, the employer exposed employees to struck-by hazards while working around commercial steel storage racks with bent and/or damaged horizontal, vertical and diagonal struts.    c) Warehouse Area- Freezer: On or about November 1, 2017, and at times prior, the employer exposed employees to struck-by hazards while working around commercial steel storage racks with bent and/or damaged horizontal, vertical and diagonal struts.    d) Warehouse Area - Ramp: On or about November 1, 2017, and at times prior, the employer exposed employees to struck-by hazards while working around commercial steel storage racks with bent and/or damaged horizontal, vertical and diagonal struts.

29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following:  Guardrail systems, safety net systems, or personal fall arrest systems:    b) Fleet Service Building - Service Pit Area: On or before November 1, 2017, and at times prior, the employer exposed employees to fall hazards, in that the employer did not ensure that the safety net system was guarding service pit area(approximately 59 inches vertical distance) when a vehicle was not entirely covering the pit area or when a vehicle was not in the service area.

Sufficient access and working space shall be provided and maintained about all electric equipment to permit ready and safe operation and maintenance of such equipment.    (a) Fleet Service Building: On or before November 1, 2017, and at times prior, the employer exposed employees to electrical shock and fire hazards, in that the employer did not ensure that the space around the electrical panel box and heater shut off were not blocked with a 55 gallon waste aerosol drum labeled as flammable, clothing, a loaded cart, and tool boxes stored within approximately 6"-2' of the electrical equipment.

29 CFR 1910.101(b): The in-plant handling, storage, and utilization of all compressed gasses in cylinders was not in accordance with Compressed Gas Association Pamphlet P-1-1965:   a) Fleet Service Building - Cylinder Storage Area: On or before November 1, 2017, and at times prior, the employer exposed employees to struck-by hazards in that the employer did not ensure that an Nitrogen storage cylinder was chained as required.
