OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from elevated surfaces:  a) At the front of the building: On or about January 05, 2018 and at times prior, the employer exposed employees to a fall hazard of 21 feet in that employees were raised while standing on a wood pallet on the forks of a JCB 507-42 extended boom forklift truck to transport the metal edging from the roof to the ground.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  a) At the front of the building: On or about January 05, 2018 and at times prior, the employer exposed employees to a fall hazard of approximately 18 feet in that employees were using the side rails of a Genie GS-1930 scissor lift to gain access to the roof were not protected from falling to the concrete side walk.   b) At the front of the building: On or about January 05, 2018 and at times prior, the employer exposed employees to a fall hazard of approximately 5 feet in that employees were using the side rails of a Skyjack SJIII 3219 scissor lift to gain leverage for drilling, were not protected from falling.
