29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying exist. Site: 1237 President Street, Brooklyn, NY. On or about 1/10/2018 a) Frequent and regular inspections of the job site and equipment were not made by a competent person. Employees working on the roof did not have any fall protection and used a ladder with insufficient length to access the roof.

29 CFR 1926.503(a)(2)(iii): The employer did not assure that each employee has been trained, as necessary, by a competent person in the use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used. Site: 1237 President Street, Brooklyn, NY. On or about 1/10/2018 a) Employees were not trained in the use and operation of personal fall arrest system or any type of fall protection. Employees working on the roof wearing a safety harnesses were not attached to any anchorage.

29 CFR 1926.1060(a)(1)(iii): The employer did not ensure that each employee using ladders and stairways had been trained by a competent person in the proper construction, use, placement, and care in handling of all stairways and ladders. Site: 1237 President Street, Brooklyn, NY. On or about 1/10/2018 a) Employee were not trained on the proper use of ladders. Employees used a 10 ft. A-Frame ladder to access the work area (roof) at an elevation at approximately 12 feet above. The top step of the ladder were used as steps.
