29 CFR 1910.147(d): Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence: a) Employees who perform servicing, maintenance and/or cleaning on or around the Black and Decker Drill Press was not required to: (1) Physically locate the electrical disconnect in such a manner as to isolate the machine or equipment from the energy source. (2) Affix a lockout or tagout devices to the electrical disconnect. In that on January 18, 2018 the Black and Decker Drill Press was not locked out to prevent employees exposure to rotating chuck parts on the Black and Decker Drill Press, part number #1551.

29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. a) The employer did not report an injury within twenty-four (24) hours of an employee being injured and hospitalized, in that an injury occurred on January 18, 2018 at 111 Waterworks Road in Ripley, Ohio and was not reported until January 25, 2018.
