29 CFR 1926.416(e)(1): Worn or frayed electric cords or cables were used:  (a) Encore Walk Townhomes, Unit #11 North Side: On or about 02/01/2018, and at times prior, the employer exposed employees to electrical shock hazards, in that electrical cords used to power circular saws and reciprocating saws were not removed from service as the cords were damaged, frayed and missing strain relief which exposed employees using these tools.

29 CFR 1926.451(b)(7): On scaffolds where platforms are overlapped to create a long platform, the overlap did not occur only over supports:  (a) Encore Walk Townhomes, Lot #11 rear side: On or about 02/01/2018, and at times prior, the employer exposed employees to collapse/fall hazards of 17-feet, 6-inches to the lower level while working from a scaffold platform, in that the scaffold platform was bridged on a pump jack scaffold platform. The overlap of platforms did not occur over a support which exposed employees engaged in cornice board installation to potential collapse.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:  (a) Encore Walk Townhomes, Lot #11 rear side: On or about 02/01/2018, and at times prior, the employer exposed employees to fall hazards while working from a scaffold plank, in that a fall protection system was not provided to employee installing cornice boards on the rear eave.

29 CFR 1926.102(a)(1): Employees were not provided with eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  (a) Encore Walk Townhomes, Unit #11 back side: On or about 02/01/2018, and at times prior, the employer exposed employees to struck-by hazards while operating pneumatic nail guns, in that protective eyewear was not provided to employees engaged in cornice board installation.  (b) Encore Walk Townhomes, Unit #16 front side: On or about 02/01/2018, and at times prior, the employer exposed employees to struck-by hazards while operating pneumatic nail guns, in that protective eyewear was not provided to employees engaged in cornice board installation.  Jose A. Rodrigues Ibarra was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 107009, citation number 1, item number 1 and was affirmed as a final order on 08/31/2015, with respect to a workplace located at 400 Belmont Place SE, Bldg. #200, Smyrna, GA 30080.
