29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) Windy Ridge Apartments, Fourth floor on east side: On or about 02/02/2018, and at times prior, the employer exposed employees to falls of 34-feet to the lower level, in that a fall protection system was not provided to employees installing metal railings on the apartment balconies.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a) Windy Ridge Apartments, Fourth floor on the east side: On or about 02/02/2018, and at times prior, the employer did not provide fall protection training, in that employees working at heights of approximately 34-feet from lower levels were not aware fall protection was needed while installing railings on a balcony. Employees were not trained to recognize a fall hazard existed and at what heights fall protection is needed.
