The laborers engaged in renovation of old laboratories were required to wear 3M, tight fitting, air purifying respirators equipped with cartridges. Condition observed on or about February 5, 2018.

29 CFR 1910.134(k)(1): The employer did not provide effective training that covered the required elements in 1910.134(k)(1)(i) through 1910.134(k)(1)(vii): (Construction Reference: 1926.59) a) Chemo Dynamics, Inc./Crossman Road South, Sayreville, NJ- Laboratory #4 and #6: The host employer failed to ensure that laborers were provided with the required training, which included provisions such as but not limited to the use, care and maintenance and storage of the respirators they were required to use. The laborers engaged in renovations of old laboratories, during which they were provided with and required to wear 3M tight-fitting, air-purifying respirators (APR), with filters for protection from the dust. Condition observed on or about February 5, 2018.

Condition observed on or about February 5, 2018.

29 CFR 1926.1101(k)(2)(ii): The building or facility owner(s) did not notify prospective employers, tenants, employees of the owner, and all employers of employees who would be performing work within adjacent areas of the presence, location, and quantity of asbestos containing material or presumed asbestos containing material, at the work sites in their buildings and facilities in writing, or a personal communication between the owner and the person to whom notification must be given or their authorized representatives: a) Chemo Dynamics, Inc./Crossman Road South, Sayreville, NJ- Laboratory #6: The host employer failed to inform laborers of the presence of asbestos on the walls of the fume hood. The workers were renovating old laboratories. Tasks performed included sanding and grinding of the fume hood walls. The workers did not speak and read in English and did not understand the warning signs. Condition observed on or about February 22, 2018.
