On or about February 15, 2018 and at times prior thereto, when workplace conditions changed the employer did not reevaluate the respiratory hazards in the workplace. This exposed the employees to respiratory hazards that exceed the PEL.

29 CFR 1910.1000(a)(2): Other substances -- 8-hour Time Weighted Averages. An employee's exposure to any substance in Table Z-1, the exposure limit of which is not preceded by a "C", exceed the 8-hour Time Weighted Average given for that substance any 8-hour work shift of a 40-hour work week. On or about February 15, 2018 and at times prior thereto, employees were exposed to Iron Oxide fumes in excess of the Permissible Exposure Level (PEL). The employees were sampled for 180 minutes with zero exposure averaged for the remainder of the 8 hour shift. Exposures were determined to be 15 mg/m3, which is 1.54 times the PEL.

An employee's exposure to any substance listed in Table Z-3, in any 8-hour work shift of a 40-hour work week, exceed the 8-hour time weighted average limit given for that substance in the table. On or about February 15, 2018 and at times prior thereto, employees were exposed to total respirable dust in excess of the Permissible Exposure Level (PEL). The employees were sampled for 247 minutes with zero exposure averaged for the remainder of the 8 hour shift. Exposures were determined to be 44 mg/m3, which is 8.754 times the PEL.

On or about February 15, 2018 and at times prior thereto, the employer did not ensure that the walking working surfaces near Line 1 CNC and plasma cutting areas were kept clean and sanitary. This exposed the employees to health hazards.
