29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use.   a.  On or about February 16, 2018 the employer did not establish and implement a written respiratory protection program with worksite-specific procedures.    All provisions of 29CFR 1910.134(c) through (o) must be covered in a respiratory protection program.  Key elements include, but are not limited to the following:      1.  Selection of respirators for employees.     2.  Medical evaluations for employees.     3.  Fit testing.     4.  Training and information.     5.  Recordkeeping.

29 CFR 1910.215(b)(9): Exposure adjustment. Safety guards of the types described in Subparagraphs (3) and (4) of this paragraph, where the operator stands in front of the opening, shall be constructed so that the peripheral protecting member can be adjusted to the constantly decreasing diameter of the wheel. The maximum angular exposure above the horizontal plane of the wheel spindle as specified in paragraphs (b)(3) and (4) of this section shall never be exceeded, and the distance between the wheel periphery and the adjustable tongue or the end of the peripheral member at the top shall never exceed one-fourth inch. (See Figures O-18, O-19, O-20, O-21, O-22, and O-23.)  a.  On or about February 16, 2018, the bench grinder on the West side of the shop did not have a tongue guard to protect the employee from injury from the abrasive wheel.   b.  On or about February 16, 2018, the pedestal grinder on the West side did not have a tongue guard to protect the employee from injury from the abrasive wheel.

Hard-service cord and junior hard-service cord No. 14 and larger may be repaired if spliced so that the splice retains the insulation, outer sheath properties, and usage characteristics of the cord being spliced.  a.  On or about February 16, 2018, the employer used a flexible cord that had a splice that did not retain the insulation or outer sheath properties approximately six inches from the black plug connected to the red flexible cord powering the blower motor on the West side of the shop located at 5885 Hwy 8 Rhinelander, WI 54501.

Chemical-specific information must always be available through labels and safety data sheets.  a.
