29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly.  a. In the warehouse area, employees lifted concrete underground utility boxes with nylon straps attached to the tines of a Caterpillar forklift without prior written approval from the forklift manufacturer. The use of the nylon straps below the tines affected the capacity and safe operation of the forklift.

29 CFR 1910.178(l)(6): Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.  a. The employer did not certify that each employee operating the forklift was trained and evaluated prior to them to operating the forklift.
