29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    a)  In the Facility, on or about May 9, 2018 - The employer did not institute a continuing effective hearing conservation program when employee noise exposures exceed an 8-hour time-weighted average sound level of 85 dBA.  An employee designated as a Lumber Inspector was exposed to noise at a level of 68.6% of the allowable limit during a 256 minute sampling period on May 9, 2018.  This exposure is equivalent to a sound level of 87.3 dBA for the dose and time of employee exposure and is 1.37 times in excess of the 85 dBA action level (50%) at which the hearing conservation program is required.
