OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:     (a) On or about March 13, 2018, and at times prior, the employer did not ensure that employees operating a Datsun forklift were protected from crush or struck by hazards where the forklift was not equipped with a seatbelt.      Abatement Note:  Among other methods, feasible and acceptable means of abatement to correct the hazard include installation of an after market seat belt for the Datsun FG103 Propane forklift.    Abatement certification and documentation are required for this item.

29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):     (a) On or about March 13, 2018, the employer did not ensure that employees exposed to mercury during fluorescent bulb recycling were informed of the hazards of mercury exposure with a written hazard communication program that would include training and safety data sheets for employees performing this task. 29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  (a) On or about March 13, 2018, the employer did not ensure that employees recycling fluorescent bulbs were trained on the hazards of mercury, which can cause central nervous system impairment, in accordance with OSHA's Hazard Communication requirements.
