OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an ejection and crushing hazard: Parking lot of building under construction: On or about March 13, 2018, an employee was exposed to an ejection and crushing hazard, while operating a JLG Forklift, Model # 6042, while not utilizing/wearing the required seatbelt.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: Window opening of 3rd floor: On or about March 13, 2018, employees were exposed to fall hazards greater than 6 feet to the concrete ground below while at the window opening of a building under construction loading construction debris onto the forks of a forklift while not protected from falls.
