29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) was not done in sequence to achieve energy control by performing the following steps as required by 29 CFR 1910.147(d)(1)-(6): 1.      Turn off and shut down power to the machinery, 2.      Physically locate and operate energy-isolating devices in such a manner as to isolate the machine or equipment from the energy source(s), 3.      Affix lockout/tagout devices to each energy isolating device, 4.      Verify isolation and de-energization of machinery have been accomplished prior to starting the maintenance and/or servicing work:    a) Production Department- On or about March 26, 2018, employees were exposed to machine hazards associated with moving parts while cleaning the scrap from the HAAS CNC machine. The employer did not implement energy control application steps as lockout/tagout devices were not applied to the electrical disconnect [per the 1910.147(d)(4) requirements]. As a result, the remaining applicable energy control elements, involving dissipation of residual energy [(d)(5)(i)], and verification of isolation [(d)(6)], were not implemented to protect employees from machine servicing hazards.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.212(a)(3)(ii): Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s):  (a) Assembly and Packing Area: On March 26, 2018, the employer did not ensure that the point of operation on the Riveter was guarded to prevent the temporary employee, operating the machine, from placing any part of their body in the point of operation.    In accordance with 29 CFR 1903.19(c), abatement certification only is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.303(b)(2): Listed or labeled electrical equipment was not used or installed in accordance with instructions included in the listing or labeling:  a) Welding Department: On March 26, 2018, the employer did not ensure that the electrical equipment was used and installed in accordance with the instructions included in the listing or labeling. An electrical junction box which is intended to be mounted on the wall and wired with permanent conduit was used as a drop down to power a fan.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
