29 CFR 1910.119(e)(3)(v): The Process Hazard Analysis did not address Facility siting: a) Pad 5, 150 Firmenich Way, Newark, NJ The employer's facility siting was inadequate, in that it did not include an analysis of building and equipment damage and injuries to personnel from overpressure caused by explosions. The employer manufactured Habanolide using vessels V-570 that contains 13,886 lbs of flammable mixture, V-57AO that contains 13,886 lbs, and V-580 that contains 20,530 lbs and an on site 70% Hydrogen Peroxide tank that contains a maximum of 20,020 lbs, on or about March 28, 2018 to September 18, 2018. 29 CFR 1910.119(j)(4)(iii): The frequency of inspections and tests of process equipment was not consistent with applicable manufacturers' recommendations and good engineering practices, and more frequently if determined to be necessary by prior operating experience: a) Pad 5, 150 Firmenich Way, Newark, NJ The employer manufactured Habanolide by mixing highly hazardous chemicals including N-Butyl Acetate, Bicyclene Oxide and 70% Hydrogen Peroxide, in reaction vessels V-570 that contains 13,886 lbs of flammable mixture, V-57AO that contains 13,886 lbs, and V-580 that contains 20,530 lbs and an on site 70% Hydrogen Peroxide tank that contains a maximum of 20,020 lbs, on or about March 28, 2018 to September 18, 2018. 1 - The employer failed to conduct external visual inspections on vessel V-570, V-57A0 and V-580 within a 5 year interval as required by industry standards, such as but not limited to API 510-2014, Section 6.4.1. Violation determined on or about June 13, 2018 2 - LSHH-571108 Switch Level, High-High, T-5711 requires preventive maintenance once every year. The employer performed the preventive maintenance on this device on 4-21-17, then again on 8-13-18, exceeding the annually required preventative maintenance interval. Violation determined on or about August 8, 2018

29 CFR 1910.119(d)(3)(i)(B): Information pertaining to the equipment in the process did not include piping and instrument diagrams (P&IDs): Pad 5, 150 Firmenich Way, Newark, NJ The employer manufactured Habanolide using vessels V-570 that contains 13,886 lbs of flammable mixture, V-57AO that contains 13,886 lbs, and V-580 that contains 20,530 lbs and an on site 70% Hydrogen Peroxide tank that contains a maximum of 20,020 lbs, on or about March 28, 2018 to September 18, 2018. a) The employer's piping and instrument diagram 570-P31 did not accurately represent equipment that was existing and was part of the process in that the piping and instrument diagram was missing the following information: 1- PSV 57020 psig setting value was not labeled. 2 - PSV 57085 psig setting value was not labeled. 3 - PSV 57084 psig setting value was not labeled. 4 - PSV 57022 psig setting value was not labeled. b) The employer's piping and instrument diagram 57A-P1 did not accurately represent equipment that was existing and was part of the process in that that the piping and instrument diagram was missing the following information: 1 - PSV 57077 psig setting value was not labeled. 2 - PSV 57A020 psig setting value was not labeled. 3 - PSV 5A7809 psig setting value was not labeled. 4 - PSV 57A013 psig setting value was not labeled. 5 - PSV 06505 psig setting value was not labeled. c) The employer's piping and instrument diagram 580-P32 did not accurately represent equipment that was existing and was part of the process in that this piping and instrument diagrams is missing the following information: 1 - PSV 58018 psig setting value was not labeled. 2 - PSE 58004 psig setting value was not labeled. 3 - PSV 58314 psig setting value was not labeled. 4 - FCV 58057 cooling water supply valve is Fail Open (FO), but not indicated as Fail Open when unlabeled valves are default Fail Closed (FC) according to the P&ID legend. 5 - XV 58016 that controls the Reactor Cooling Water line is Fail Open (FO), but not indicated as Fail Open when unlabeled valves are default Fail Closed (FC) according to the P&ID legend. 6 - V-580 was de-rated in 1995 from a Maximum Allowable Working Pressure (MWAP) of 250 psi to 150 psi but the P&ID continued to note an MWAP of 250 psi. Violation determined on or about May 23, 2018

29 CFR 1910.119(d)(3)(ii): The employer did not document that equipment complies with recognized and generally accepted good engineering practices: a) Pad, 150 Firmenich Way, Newark, NJ The employer manufactures Habanolide using vessel V-580 to react chemicals including approximately 19,067 lbs of Bicyclene Oxide Hydroperoxide, a flammable liquid, with 150 lbs of n-Butyl Acetate. The vessel was rerated June 2, 1994 from 250 PSI to 150 PSI because of a new valve welded into the opening. However, the employer failed to update the vessel's nameplate with required information as required by industry standards, such as but not limited to API 510-2014, Section 8.2.2. Violation determined on or about June 13, 2018
