29 CFR 1910.1200(e)(1):  The employer did not develop, implement, and maintain a written hazard communication program which at least described how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also included a hazardous chemicals list and methods used to inform employees of the hazards of non-routine tasks:    (a)  Donnie Suazo Construction at 1121 Dillon Dam Road Frisco, CO 80443:  On or before April 4, 2018 the employer did not develop, implement, and maintain a written hazard communication program which at least described how to properly read and comprehend chemical labels and other forms of warning and safety data sheets. The hazard communication program did not include a hazardous chemicals list, and an employee training program with methods used to inform employees of the hazards of non-routine tasks.    29 CFR 1926.59: Note: The requirements applicable to construction work under this section are identical to those set forth at 1910.1200 of this chapter.

29 CFR 1910.1200(g)(1): Employers did not have a safety data sheet in the workplace for each hazardous chemical which they use:  (a) Donnie Suazo Construction at 1121 Dillon Dam Road Frisco, CO 80443:  On or before 4/4/18, the employer did not maintain a safety data sheet for each hazardous chemical used on location. The employees used Tight-bound wood glue at this construction site.  This condition exposed employees to chemical irritations to eyes, respiratory, and skin due to employee lack of knowledge regarding chemical hazards.   29 CFR 1926.59: Note: The requirements applicable to construction work under this section are identical to those set forth at 1910.1200 of this chapter.

29 CFR 1910.1200(h)(1): Employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets:  (a) Donnie Suazo Construction at 1121 Dillon Dam Road Frisco, CO 80443: On or before 04/04/18, the employer did not provide information and training to employees in regards to safety data sheets.  Employees used Tight Bound Wood Glue when performing work on the construction site. 29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501:    (a) Donnie Suazo Construction at 1121 Dillon Dam Road Frisco, CO 80443:  On or before 04/04/18, the employer did not insure that employees were protected from fall hazards while constructing a residential property. An employee was performing work on the 3rd story roof without the use of fall protection or a fall protection system. This condition exposed the employee to fall hazards of approximately 30 feet.

29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii):  (a) Donnie Suazo Construction at 1121 Dillon Dam Road Frisco, CO 80443: On or before 4/4/18, the employer did not provide fall protection training to address the fall hazards of the construction site.  Employees were working on the third floor of this construction project without adequate fall protection training.  This condition exposed employees to several different safety hazards on location due to lack of knowledge.   29 CFR 1926.503(a)(2)(i) through (viii) include the following items:   (i) The nature of fall hazards in the work area;  (ii) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used;   (iii) The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used;   (iv) The role of each employee in the safety monitoring system when this system is used;   (v) The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs;  (vi) The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and  (vii) The role of employees in fall protection plans; and  (viii) The standards contained in this subpart.
