29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person and were not constructed and loaded in accordance with that design: a) Jobsite: On or about April 6, 2018, and at times prior thereto employees performed framing activities from a scaffold platform that was supported by a rough terrain forklift. The scaffold platform was not designed and constructed by a qualified person in that the platform was constructed out of OSB (Oriented Strand Board) and secured to the forklift with a ratchet tie down strap. The employees were exposed to an approximate 20 foot fall to the ground below. b) Jobsite: On or about April 6, 2018, and at times prior thereto employees performed framing activities from a scaffold platform that was supported by a rough terrain forklift. The scaffold platform was not designed and constructed by a qualified person in that the manufacturer warned of a personal injury hazard, prohibiting use of the machine as a personal lift, or to fit the machine with any form of personnel work platform. The employees were exposed to an approximate 20 foot fall to the ground below. Note: Abatement certification IS required this item.

The requirements applicable to construction work under this paragraph are identical to those set forth in 29 CFR 1910.178(l) 29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer did not ensure that each operator has successfully completed the training required by this paragraph (l): a) Jobsite: On April 6, 2018 and at times prior thereto employees had not been provided with powered industrial truck (forklift) training from the employer to ensure the employees were familiar with truck related topics, workplace related topics, and safe operations. Employees operated a GENIE GTH-844 rough terrain forklift while performing framing activities. Note: Abatement certification IS required this item.
