29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:    (a) Facility, 1924 McCague Street, Pittsburgh, PA:  On or about April 11, 2018 the employer did not develop or implement a plan or program to identify job site hazards which assists employees in maintaining a safe working environment.  Such programs would support the employer and employees in identifying and avoiding potential hazards such as, but not limited to: cave-ins during job site operations thereby decreasing the probability of employee injury.

29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation:  (a) Jobsite, 8 North Avenue, Pittsburgh, PA:  On or about December 13, 2017 an employee was working in an excavation that had water accumulation of six inches or more and no protective systems were in place to protect employees against cave-ins.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:  (a) Jobsite, 8 North Avenue, Pittsburgh, PA:  On or about December 13, 2017 daily inspections of the excavation was not made by a competent person.  Employees were permitted to work in an excavation with an accumulation of water and no protective systems were in place.  An employee sustained broken vertebrae in their back when a section of a sidewall collapsed and struck the employee.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):    (a) Jobsite, 8 North Avenue, Pittsburgh, PA:  On or about December 13, 2017 employees working in an excavation approximately 4-5 feet deep with vertical side walls and an accumulation of water were not protected from cave-ins by the use of protective systems in accordance with sections (b) or (c).  An employee sustained broken vertebrae in their back when they were struck by a section of sidewall that collapsed and knocked to the ground and into the water.

29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye:  (a) Facility, 1924 McCague Street, Pittsburgh, PA:  On or about December 13, 2017 an employee sustained injuries from a trench cave-in that resulted in an in-patient hospitalization.  The employer did not report the work-related incident to the Occupational Safety and Health Administration within 24-hours as required.
