29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: 239 Narragansett Blvd, Chicopee, MA On May 23, 2018 and at times prior, the employer's energy control procedures were not used by employees who performed maintenance and servicing activities. a. Employees and managers who set up the alligator shear for use or cleaning did not follow the procedure when they added a wood block to protect against a second source of hazardous energy not identified in the procedure. b. On April 13, 2018 and at times prior, employees who reached inside the horizontal bailer did not utilize the procedure and were exposed to crushed-by hazards. The employees did not have exclusive control of the lockout device due to the lockout key being left attached by chain to the machine.

29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed: 239 Narragansett Blvd, Chicopee, MA As of May 23, 2018, the employer had not performed a periodic inspection that ensured each procedure was inspected for inaccuracies during an actual energy control task and did not include a review, between the inspector and each authorized employee, of that employee's responsibilities under the energy control procedure.

29 CFR 1910.147(c)(7)(i): The employer did not provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees: 239 Narragansett Blvd, Chicopee, MA On April 13, 2018 and at times prior, the employer provided verbal on-the-job energy control training to authorized and affected employees. The employer did not train employees on the written energy control program procedures and an employee did not understand the safe usage of energy controls. The employee was exposed to crushed-by hazards due to a lack of exclusive control of a bailer lockout device; the lockout device key was attached by a chain to the machine.

The blade guard was inoperative and unable to be adjusted fully downward; the guard would have allowed access to the danger zone even at full adjustment. On April 9, 2018, an employee received an amputation injury while operating the alligator shear.
