1910.1001(j)(4):  Warning labels were not affixed to all raw materials, mixtures, scrap, waste, debris, and other products containing asbestos fibers, or their containers. When a building owner or employer identifies previously installed asbestos containing material (ACM) and/or presumed asbestos containing material (PACM), labels or signs were not affixed or posted so that employees were notified of what materials contained ACM and/or PACM.    a) Lock Up Irving Park LLC: On or about April 11-12, 2018, at the jobsite located at 1650 W. Irving Park Rd. Chicago, Illinois, the employer, did not affix labels or post signs identifying materials that were ACM and/or PACM at the jobsite, including but not limited to Thermal System Insulation on pipes.

29 CFR 1926.1101(k)(2)(ii)(B): The building owner and/or facility owner did not notify employees of the owner who will work in or adjacent to areas containing asbestos containing material or presumed asbestos containing material of the presence, location and quantity:    a) Lock Up Irving Park LLC: On or about April 11-12, 2018, at the jobsite located at 1650 W. Irving Park Rd. Chicago, Illinois, the employer did not ensure that employees of the facility owner who worked in and/or adjacent to areas containing Asbestos Containing Material (ACM) were informed of the presence, location and quantity of the ACM. Sub-contractor employees performed demolition and removal activities in the area including removal of Thermal Insulation System (TSI) on piping.

29 CFR 1926.1101(k)(2)(ii)(C): The building owner and/or facility owner did not notify all employers of employees who work within or adjacent to the areas containing asbestos containing materials (ACM) and presumed asbestos containing materials of the presence, location and quantity:    a) Lock Up Irving Park LLC:  On or about April 11-12 , 2018, at the jobsite located at 1650 W. Irving Park Rd. Chicago, Illinois, the employer failed to inform the sub-contractors and their employees of the presence, location and quantity of asbestos containing material or presumed asbestos containing material, including but not limited to thermal system insulation, when they performed demolition and renovation activities at the facility.
