29 CFR 1926.451(c)(1): Supported scaffolds with a height to base width (including outrigger supports, if used) ratio of more than four to one (4:1) were not restrained from tipping by guying, tying, bracing, or equivalent means, as set forth in subparagraphs (i) - (iii) of this paragraph.    On or about April 14, 2018, and in times prior thereto, workers were using a scaffold that was 29 inches wide to access elevations of up to 18 feet without attaching the required outriggers.  This exposed the drywall workers to a fall hazard of over 10 feet, located at the outlet mall, space #1045.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:    On or about April 14, 2018, and in times prior thereto, the guardrails required when stacking a Baker type scaffold reaching were not used.  Workers were exposed to a fall hazard of over 10 feet to the concrete floor below without fall protection, located at space #1045 at the indoor outlet mall.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.    On or about April 14, 2018, and in times prior thereto, workers were using a Werner, narrow frame scaffold, to hang drywall, located at space #1045 at the indoor outlet mall.  Workers were not trained to use the outriggers and to provide fall protection when stacking scaffold, exposing them to the hazards of falls.

On or about April 14, 2018 a work-related incident resulting in one worker being hospitalized was not reported to OSHA within 24-hours. The incident was located at the space #1045 at the indoor outlet mall in San Marcos, TX.
