OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees, in that, employees are exposed to a crushing and/or drowning hazard due to potential roll-over when operating zero-turn ride-on mowers at areas of variable slope and at sloped embankments in close proximity to a large body of water:  a. At the site, a Toro 5000 series 72 inch zero-turn riding mower with a serial number 315000107 and a model number 74944, was used with a missing top section of the rollover protective structure. The folding section of the rollover protective structure was removed and not replaced exposing employees to the hazard of being crushed by the mower in the event of tipping over. Employees would operate the mower near a lake on slopes up to 20 degrees as observed on or about 04/24/2018.   b. At the site, a Hustler Super-Z 60 inch zero-turn riding mower with a serial number 11111816 and a model number 929927, and a Hustler Super-Z 60 inch zero-turn riding mower with a serial number 13024976 and a model number 932145 were used without rollover protective structures. The roll-over protective structures were removed and not replaced exposing employees to the hazard of being crushed by the mowers in the event of tipping over. Employees would operate the mowers near a lake on slopes up to 20 degrees as observed on or about 04/24/2018.   c. At the site, a Hustler Super-Z 72 inch zero-turn riding mower with a serial number 15022928 and a model number 934349 was used without a rollover protective structure. The roll-over protective structure was removed and not replaced exposing employees to the hazard of being crushed by the mower in the event of tipping over. Employees would operate the mower near a lake on slopes up to 20 degrees as observed on or about 04/24/2018.
