On or about April 25, 2018, and at times prior thereto, three employees were not protected by eye or face protection while using hammers, grinders and drills on the construction site, exposing the employees to the hazard of being struck by flying debris.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:  On or about April 25, 2018, and at times prior thereto, a metal platform/basket installed on the GEHL RS-5 rough terrain forklift was used to elevate personnel to perform work on the commercial property under renovation. The forklift was not designed for such use per the manufacturer's operations manual, exposing employees to the hazard of falling approximately 20 feet.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:   On or about April 25, 2018, one employee was working from an elevated metal platform/basket that was not securely attached to the lift to prevent the platform from sliding off. The platform was used with the GEHL RS-5 rough terrain forklift to access elevated positions on the commercial property under renovation, exposing employees to a fall hazard of approximately 20 feet.

29 CFR 1926.602(d): The requirements applicable to construction work under this paragraph are identical to those set forth at 1910.178(l) of this chapter.  Each powered industrial truck operator did not complete training as required.  29 CFR 1910.178(l)(1)(ii) Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).  On or about April 25, 2018, and at times prior thereto, the employer did not ensure that the operator of the GEHL Model RS5 rough terrain forklift was trained and certified in the safe operations of the forklift.
