29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    On or about 04/26/2018, at the construction site located at 1720 Clark Ave., Saint Louis, Missouri,  workers engaged  in  the instillation of a water-proofing system on the vertical concrete wall were not protected from falling into an excavation that was approximately 12 feet deep. The workers were leaning on the edge of the excavation while affixing the Core-flex (yellow tarp) to the top of the excavation without any means of fall protection.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:(a)(LOCATION)(IDENTIFY SPECIFIC OPERATION(S) AND/OR CONDITIONS)    On or about 04/26/2018, at the construction site located at 1720 Clark Ave.,  Saint Louis, Missouri, the portable ladder used to access an excavation that was approximately 12 feet deep was not extended three feet above the landing.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person.  On or about 4/26/2018, at the construction site located at 1720 Clark Avenue, where workers engaged in instillation of waterproofing system on concrete foundation wall were exposed to falling into unprotected excavation, the employer did not ensure that a site inspection was made by a competent person.
