29 CFR 1903.19(d)(1): The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  a) Shawn Tovar failed to provide documentation demonstrating the abatement method and completion of the following items as cited:      a) Citation 1, Item 1: Ensure that fall protection has been provided and utilized during construction work at heights greater than 6 feet.      b) Citation 1, Item 2: That fall protection training has been provided to employees that were exposed to fall hazards greater than six feet during residential roofing work.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  (a)  On or about May 1, 2018 at the 352 W. 9th Ave., Oshkosh, WI 54902, fall protection was not utilized while performing roofing activities on the upper roof level exposing employees to fall hazards.  (b)   On or about May 1, 2018 at the 352 W. 9th Ave., Oshkosh, WI 54902, fall protection was not utilized while performing roofing activities on the lower roof level exposing employees to fall hazards.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  On or about May 1, 2018 at the 352 W. 9th Ave., Oshkosh, WI 54902, the employer, with employees exposed to fall hazards, did not provide a training program to enable each employee to recognize the hazards of falling, and the procedures to be followed in order to minimize these hazards.
