The north and south banks of the trench were vertical.  No protective system was utilized to protect the employee from a cave-in hazard.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder:    a) On or about 05/01/18, in a trench located in front of a house at 52 Brantford Place, Buffalo, NY:  An  employee was working in a trench/excavation that was 7 ft. 11 in. deep.  The bottom half of an extension ladder  was placed in the trench at the east end  and the employee used this ladder to access and exit the trench. The siderails of this ladder were approx. 2 inches below the top of the trench, and could not be extended higher because of the length of the ladder.  The ladder was not secured at the top, and a grasping device such as a grabrail was not provided to assist employees in mounting and dismounting the ladder.   NO ABATEMENT CERTIFICATION REQUIRED
