29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a)K & L Mechanical, Inc. at 25 1st Street NW, Watertown, SD 57201:  On or about and at times prior to May 8, 2018, the employer did not ensure that each employee was protected from falls in that, the ladder that was placed for employee access/egress from the excavation extended at least three feet above the upper landing surface of the excavation. This condition exposed employees to fall hazards.

29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purposes for which they were designed:  (a) K & L Mechanical, Inc. at 25 1st Street NW, Watertown, SD 57201:  On or about and at times prior to May 8, 2018, the employer did not follow the manufacturer's instructions in that, an extension ladder was separated and one portion of the ladder was used for access/egress from an excavation. This condition exposed employees to a fall hazard associated separating an extension ladder that the manufacturer intended to be used with the two sections connected and exceeding the maximum load limit causing the ladder to fail.
