29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: (a) Jobsite: On or about May 11, 2018, two employees were working in an excavation and they were not wearing hard hats. The excavation ranged in depth from about 7 1/2 feet to 9 feet and the two employees were working next to a near vertical sidewall.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: (a) Jobsite: On or about May 11, 2018, the competent person did not remove two employees from working in an excavation that had not been shored nor sloped. In addition, the employer did not conduct any soil tests to determine the Class of soil that the employees were working with.
