29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) 4022 Country Club Road (Mobile, Alabama):  On or about May 14, 2018, and at times prior; the employer allowed his employee(s) not to wear hard hats to perform construction activities beneath a four buck scaffolding system; exposing employees to struck-by hazards from falling or flying materials, equipment and tools. The scaffold system was located on the front north face of the structure.  b) 4022 Country Club Road (Mobile, Alabama):  On or about May 14, 2018, and at times prior; the employer allowed his employee(s) not to wear hard hats to perform construction activities beneath a four buck scaffolding system; exposing employees to struck-by hazards from falling or flying materials, equipment and tools. The scaffold system was located on the side east face of the structure.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  a) 4022 Country Club Road (Mobile, Alabama); On or about the May 14, 2018, and at times prior thereto, the employer exposed his employees up to approximately a thirty five (35) foot fall hazard in that employees were allowed to perform waterproofing activities from the top level of a four buck scaffold system without fall protection such as but not limited to guardrail systems, personal fall arrest systems, or safety net systems. The scaffold system was located on the front north face of the structure.  b) 4022 Country Club Road (Mobile, Alabama); On or about the May 14, 2018, and at times prior thereto, the employer exposed his employees up to approximately a thirty five (35) foot fall hazard in that employees were allowed to perform waterproofing activities from the top level of a four buck scaffold system without fall protection such as but not limited to guardrail systems, personal fall arrest systems, or safety net systems.
