29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. On May 23, 2018 located on the orth side of a residential construction site, employees were performing underground sanitary sewer repair while working inside an excavation in that the employees had not been trained on the applicable procedures or regulation to minimize those hazards associated with trenching and excavation. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: On May 23, 2018 located on the north side of a residential construction site, an employee was observed installing a sanitary sewer line in an excavation in excess of 5' in depth without adequate protection against cave-ins, in that the walls of the excavation were not properly sloped, shored, benched or otherwise adequately protected against collapse.
