OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. a) Dry Blend Room; On May 23, 2018 and at times prior, the employer exposed employees to crushing and struck-by hazards in that employees were allowed to walk and work around steel storage racks which were damaged and leaning. b) Dry Blend Room; On May 23, 2018 and at times prior, the employer exposed employees to crushing and struck-by hazards in that employees were allowed to walk and work around steel storage racks where the column base plates were not anchored to the floor.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: a) Warehouse: On May 23, 2018, and at times prior, the employer exposed employees to struck-by and crushed-by hazards in that employees were allowed to operate a forklift with a basket attachment, that had not been certified by the manufacturer of the forklift and did not have updated instruction plates, tags, or decals.
