OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of thermal burn. On or about May 5, 2018, Jacques-Imo Cafe, LLC employees dispensed hot cooking oil from the Fry Master exposing them to thermal burn.

29 CFR 1910.25(b)(1): The employer did not ensure handrails, stair rail systems, and guardrail systems were provided in accordance with 1910.28(b)(11) Table D-2. On or about May 5, 2018, at Jacques-Imo Café, LLC, the employer failed to ensure that a stair rail system was installed at the service entrance/exit. Employees used the stairway as a service entrance throughout the day. This condition potentially exposed employees to a fall hazard.

29 CFR 1910.25(b)(5)(i): When a door or gate opens directly on a stairway, a platform was not provided and/or the platform did not provide a useable depth greater or equal to 20 inches. On or about May 5, 2018 at Jacques - Imo Café, LLC the service entrance door opened directly onto the stairway. The stairway was not equipped with a platform. Employees used the service entrance as a quick cut through for the dining area next door, walk in cooler, trash disposal and cooking oil dispenser. This condition exposed employees to a potential fall hazard.
