29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used:   a) On or about 06/11/18, on a roofing jobsite, at a house at 47 East Cavalier Drive,  Cheektowaga, NY:  A ladder Jack Scaffold  was erected on the south side of the house.  The scaffold had two support ladders, and the brackets that supported the aluminum pik were on the outside (south side of the ladder).  Employees climbed over the brackets to get on the pik.  Direct access to the pik was not provided.   NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:   a) On or about 06/11/18, on a roofing  jobsite, located on a house at 47 East Cavalier Drive,  Cheektowaga, NY:  Employees  engaged in roofing  work on a steep roof at the southeast  area of the house  were  exposed to a fall of approx.  10 to 17 ft.  No fall protection system was utilized.  Pitch of the roof was approx.  9 in 12.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    a) On or about 06/11/18, on a roofing jobsite, at a house at 47 East Cavalier Drive,  Cheektowaga, NY:  Employees engaged in construction work including roofing & clean-up were not trained to recognize potential hazards on this type of jobsite, including but not limited to falls from roofs, ladders, skylights, scaffolds, electrical hazards, unguarded tools/machines, and the need for personal protective equipment to protect them from various hazards. They also were not trained in the applicable OSHA regulations to control or eliminate these hazards.    ABATEMENT CERTIFICATION REQUIRED
