OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being ejected from the all terrain vehicle: On or about June 19, 2018, and at times prior thereto, the employer was using all-terrain vehicles to transport employees off-road to the work location without ensuring that employees were restrained in the seats to prevent ejection in the event of a rollover.
