OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the struck-by or crushing hazards when operating a forklift without the use of a restraint device:     (a) On June 21, 2018; the employer did not require employees to wear a seat belt while operating the Komatsu WA95-3H, S/N: H20704 Wheel Loader.    (b) On June 21, 2018; the employer did not ensure the backup alarm was functional prior to operating the Komatsu WA95-3H, S/N: H20704 Wheel Loader.
