29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a) GT Painting, Inc. at 2131 Lawrence, Denver, CO 80205: On and before June 22, 2018, the exposing employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury. The employer directed the employees to manually lift 18 foot long, 10 inch wide sections of metal decking up 6 flights of stairs for a new deck on the roof. The employer did not instruct employees on safe means and methods to lift these materials, and to stay clear of the drop zone after handling the planks. An employee was fatally injured when he was struck by a falling metal plank. This condition exposed employees to the hazard of being struck-by falling objects.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: (a) GT Painting, Inc. at 2131 Lawrence, Denver, CO 80205: On and before June 22, 2018, the exposing employer did not ensure that employees working in areas where there was a possible danger of head injury from falling objects were protected by protective helmets. Employees lifted metal planks up six flights of stairs by holding the planks over the edge of the stair rails, and manually lifting the planks up in between the flights of stairs. The planks were 18 feet long, 10 inches wide, and weighed an estimated 80 pounds each, with multiple planks being hoisted up over a period of 8 hours. The employees were not trained to stay clear of the drop zone after lifting. This condition exposed employees to the danger of head injuries from falling planks caused by the lack of adequate head protection.
