29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).  On or about June 28, 2018, the employer did not ensure that the operator of the rough terrain forklift was trained in the safe operations of the forklift, exposing employees to hazards such as, but not limited to, being struck by moving objects, struck by falling loads, crushed by forklift tipping and exposing employees to fall hazards by lifting employees in an unapproved fork mounted personal work platform.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use.    a. On or about June 28, 2018, at the construction site located at 300 East 3rd Street, Dover, Ohio, the employer failed to ensure that the unapproved personal work platform attached to the Gradall G6-42 rough terrain forklift (S/N 0189231) was specifically designed by the manufacturer for lifting and transporting employees, thereby exposing employees to a fall hazard of approximately 15 feet.

29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.    a. On or about June 28, 2018, at the construction site located at 300 East 3rd Street, Dover, Ohio, an employee was providing roofing material to a co-worker working on a roof approximately 20 feet above the ground. The employee was inside a wooden box, an unapproved personal work platform, chained to the mast and supported by the forks of a rough terrain forklift. The box and employee were elevated approximately 15 feet above the ground level. The employee was not using a fall arrest system and a standard railing mid-rail was not provided exposing the employee to a fall hazard.

Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems.  a) On or about June 28, 2018 at 300 East 3rd Street, Dover Ohio, an employee working on a 10/12 pitch roof was exposed to a fall hazard of approximately 20 feet while performing a metal roof installation without the use of a fall protection system.
