29 CFR 1910.28(b)(13)(i): The employer did not ensure that each employee was protected from falling by a guardrail system, safety net system, travel restraint system or personal fall arrest system when work was being performed less than 6 feet (1.6m) from the roofs edge: Fall protection was not provided for employees working on the roof of the fertilizer storage building, when loading fertilizer from a portable conveyor into roof openings. Exposure also existed when the employee walked on the roof from the ladder to the roof openings. (Note: 1910.28(b)(13)(ii) allows designated areas when work is conducted 6 to 15 ft from the edge but only if the work is both infrequent and temporary.) Abatement documentation is required for this violation.

29 CFR 1910.22(d)(1): Walking-working surfaces were not inspected, regularly, and maintained in a safe condition. At the fertilizer building, the ladder used to access the roof for loading fertilizer was used with a lag bolt not secured and the right side of the ladder attached in a manner that did not prevent movement. (Note: the ladder, at the time of the inspection, was capable of being used. Abatement can be made by replacement with another roof access structure such as stairs.) Abatement documentation is required for this violation.
