OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to fall, struck by and caught in hazards while riding in an excavator bucket. Worksite: An employee was riding in a bucket of the Caterpillar excavator in order to get out of the 4-foot deep trench. Among other methods, a feasible and acceptable means of abatement could include, but may not be limited to: 1. Follow the Caterpillar operator's manual which states Do not operate the machine while someone is hanging on or in the bucket or attachments. 2. Follow the Association of Equipment Manufacturers (AEM) Safety Manual for Operating and Maintenance Personnel Hydraulic Excavator, Dated February 2003, Which States Warning: Never use a bucket for a work platform or personnel carrier. 3. Follow the NIOSH publication, preventing injuries when working with hydraulic excavators and backhoe loaders, which states Never permit workers to ride in or work from excavator or backhoe loader buckets. 4. Utilize other safe means, such as (but not limited to) provide a ladder or equivalent, slop the trench wall, or other means.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: Worksite: The employer did not ensure that the employee required to work in the 4-foot deep trench was provided with a safe means of egress by the use of a stairway, ramp, or ladder.
