OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to explosion, burn, and penetrating trauma hazards.    a) Bakery, 8 Silk Mill Drive, Hawley, PA - Employees toasted pastries with a Mag-Torch Model MT 535 Torch Head with a broken valve (could not be turned off) and were exposed to explosion, burn and penetrating trauma hazards. An employee received burns when excess propane from the cylinder ignited and created a fireball, on or about June 16, 2018.    In accordance with 29 CFR 1903.19, abatement certification is required for this violation.

29 CFR 1910.303(b)(1)(i) - Electric equipment was not free from recognized hazards that were likely to cause death or serious physical harm to employees, in that the installed electrical outlets were not suitable for use within six (6) foot of a sink or within a kitchen exposing employees to contact with an electrical current and fire hazards:    a) South Corner, Bakery, 8 Silk Mill Drive, Hawley, PA - A paired set of duplex receptacles (located three (3) foot northwest of the employee hand sink) used by employees for preparing bakery products with electrical equipment, such as but not limited to a Chefman Model RJ23-SM Electric Griddle, a Spring USA Model SM-181R MAX Induction Range, and a a Globe Food Equipment Model PF10E Countertop Electric Fryer lacked ground-fault circuit interrupter (GFCI) protection exposing employees to contact with an electrical current and fire hazards, as observed on or about June 29, 2018.    In accordance with 29 CFR 1903.19, abatement certification is required for this violation.

29 CFR 1910.303(b)(1)(ii): Electrical equipment was not free from recognized hazards, based on the mechanical strength and durability, including, for parts designed to enclose and protect other equipment, the adequacy of the protection thus provided:  a) North Corner, Bakery, 8 Silk Mill Drive, Hawley, PA - The top cover of the Linkrich Model 50L Spiral Mixer directly southeast of the stainless steel two-compartment sink was damaged with two (2) holes that allowed flour dust and water to coat the inner electrical connections exposing employees to contact with an electrical current and fire hazards, as observed on or about June 29, 2018.  In accordance with 29 CFR 1903.19, abatement certification is required for this violation.

29 CFR 1910.304(b)(4)(ii)(B): Where connected to a branch circuit supplying two or more receptacles or outlets, a receptacle may not supply a total cord- and plug-connected load in excess of the maximum specified in Table S-4:  a) South Corner, Bakery, 8 Silk Mill Drive, Hawley, PA - Employees prepared baked products at the same time with combinations of a Chefman Model RJ23-SM Electric Griddle operated at 1200 watts (10 amps), a Spring USA Model SM-181R MAX Induction Range at 1800 watts (15 amps), and/or a Globe Food Equipment Model PF10E Countertop Electric Fryer at 1700 watts (14.2 amps) powered from a paired set of duplex receptacles through a 20 amp Eaton Model BR120 Circuit Breaker which exceeded the maximum capacity of 16 amps found in Table S-4. Employees were exposed to contact with an electrical current and fire hazards, as observed on or about June 29, 2018.  In accordance with 29 CFR 1903.19, abatement certification is required for this violation.
