29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  Shop: On August 2, 2018  an employee was exposed to an 8-hour time weighted average of 91.0 dBA (an equivalent dose of 117.3%) while polishing and cutting stone counter tops.  All components of a hearing conservation program were not implemented including noise monitoring, audiometric testing, noise training, and posting of the noise standard 29 CFR 1910.95.

29 CFR 1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered:  Fabrication Shop: The forklift was used with a boom attachment to move stone slabs and was not marked with all the required information.
