29 CFR 1960.26(b)(5): Whenever and as soon as it is concluded on the basis of an inspection that a danger exists which could reasonably be expected to cause death or serious physical harm immediately, the inspector did not inform the affected employees and official in charge of the workplace of the danger. The official in charge of the workplace, or a person empowered to act for that official, did not undertake immediate abatement and the withdrawal of employees who are not necessary for abatement of the dangerous conditions. In the event the official in charge of the workplace needs assistance to undertake full abatement, that official did not promptly contact the Designated Agency Safety and Health Official and other responsible agency officials, who did not assist the abatement effort. Safety and health committees were not informed of all relevant actions and representatives of the employees were not so informed: a) On or about July 9, 2018 on the cemetery grounds, employees were exposed to the hazard of occupational hearing loss during lawn care operations and the employer failed to undertake immediate abatement or withdraw employees from the hazardous conditions and assistance was not provided between the Designated Agency Safety and Health Official and the official in charge of the workplace.

29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided in this paragraph by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels: On or about July 9, 2018, cemetery grounds, employees were exposed to permanent hearing loss associated with operating Grasshopper riding mowers with an occupational noise time-weighted average of 89.0 to 93.9 dBA and the employer failed to implement an audiometric testing program for employees exposed over 85 dBA time-weighted average.
