29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  (a)  492 Dink Road- Ivydale, WV:  On or about June 21, 2018 employees were performing jackhammer operations on concrete for up to one hour in one workday and the engineering controls, work practices, and respiratory protection were not done in accordance with table 1 of the regulation.  (b)  492 Dink Road- Ivydale, WV:  On or about June 22, 2018 employees were performing jackhammer operations on concrete for up to five hours in one workday and the engineering controls, work practices, and respiratory protection were not done in accordance with table 1 of the regulation.

29 CFR 1926.1153(d)(2)(ii): The employer did not assess the 8-hour TWA exposure for each employee on the basis of any combination of air monitoring data or objective data sufficient to accurately characterize employee exposures to respirable crystalline silica:   (a)  492 Dink Road- Ivydale, WV:  On or about June 21, 2018 employees were performing jackhammer operations on concrete for up to one hour in one workday and an exposure assessment was not done in accordance with paragraph (d)(2)(ii) or (d)(2)(iii).  (b)  492 Dink Road- Ivydale, WV:  On or about June 22, 2018 employees were performing jackhammer operations on concrete for up to five hours in one workday and an exposure assessment was not done in accordance with paragraph (d)(2)(ii) or (d)(2)(iii).
